Template for claiming back unfair bank charges

Dear Sir/Madam,
Ref: Account number: xxxxxxxx (your account number)
I understand that the charges which were applied to my bank account with regards to the following (enter all relevant details here) are unlawful.
At the time of opening my bank account, I entered into a contract with you. At this time, you agreed to act lawfully at all times. However, the fees that you have been applying to my account in relation to the above are unlawful under Common Law, Statute and consumer regulations.
You have taken £xxxxx (enter full charges here) from me and £xxxx (enter overdraft interest amount here) in overdraft interest. I am now requesting that the total sum of £xxxx (enter total sum here) is repayed back to me and that any default notices which were entered on my credit record because of these charges are removed completely.
Please ensure that the default notices are removed and the money is repaid in full within 14 days. If these actions are not complete in 14 days time, I will start a claim against you for the full amount plus interest, and my costs.

i have worked out that i am owed over 3,000, have written to the bank and now await a reply. I have been told that lloyds will settle out of court, so here goes…..

Can anyone advise do the banks (Hsbc/Halifax) purposely delay any responses to correspondences sent to them in relation to the “UNFAIR BANK CHARGES”.

Ryan, what sort of delays are you experiencing? Difficult to comment without knowing the ins and outs, but if they are being difficult, you can start court proceedings. Banks don’t want to go to court, so you may find they start being a little more helpful?

I have sent my first letters via recorded delivery to two banks that owe me. I have checked and find out that one bank has not signed for the letter delivery today @10:45 am surely the banks would be open by then, so the letter is back at post sorting office. I will wait another two days, if not I will start my court proceedings. Has anyone experienced this before???
I heard that they are now fighting back by clossing the account, is this true? If it is true, I really dont care I just want my money that they robbed off me all these years, sometimes £90.00 a day I dont even earn that much in a day!
Is this applicale to Credit Cards as well???

I am sent first letter to Halifax today to claio, back 2500,BUT i am worried in case they decide to close my account, can they do this?

You can write to the bank and ask for copies of your statements. If they want you to pay more than £10 in total for your statements, write to their data controller and ask them for information on your past charges – they can charge you up to £10 for this information and have to give it to you under the Data Protection Act.

Thank you. I contacted my bank today and they informed me that £10 would be charged for each separate account I hold if the page is 1 or 50 pages long, the money gets deducted from your bank automatically. Also banks only keep statements for the maximum of six years after that they are classed as historical. I will be watching this site avidly for the forseeable future. Kind Regards Elaine

Has anyone got an answer about late payments to credit card companies? Nat West are charging interest for the period between statement date and payment date., even though payment was made in full and on time.
They say “It’s in our agreement” and won’t respond when asked to justify.

Dont see why not jenna – they might try and get you to pay some money for getting your account statements and stuff, but it’s free to try and you might get the money back. Depends whether you wanna spend the time writing the letters and things

I’ve forward all the details to my bank HSBC and they are being very very very sneaky.
I emailed a claim on the 08 March 07, was told it will take 6-8 weeks for a settlement but it shouldn’t take that long.
I got a reply on the 16 March saying they are investigating the issue and will get back to me.
Everytime I enquiry about what stage they’re at I get told 6-8 weeks, fine I’ll leave till then. So I called on Saturday 19 May, to find out what is going on. I get told by Telephone banking that they sent me a reply on the 13 March. I pointed out to the operator that means they are even later getting back to me. Unsettled by this she turns around and tells me they have no time scale on replying!
I did explain to her it took me 40 minutes to work out 6 years worth of charges and interest and find it outragous that it takes them so long. Do they have a team of monkeys working this out?
To date they are still ignoring me. Anyone know how I can speed this up?

am i still entitled tooverdraft charges.
